I have recently been convicted of a sex crime and have decided to take the plea bargain of 18-36 months of probation and registry to the SOR. The crime was committed in a different state in which I am not a resident of and have been told by my lawyer that if I do not want to live in the state in which the crime was committed, that I should have an address of a new residence before sentencing...any suggestions? I have a bachelors degree and have thought about going back to school but after reading many posts about the difficulties of finding jobs, I think that taking out additional loans would be pointless. I really have no preference on a state, I have lost all friends and many family members so going to a new state far away would be just fine. This is a whole new hell for me and I'd appreciate any help I can get.

Unjust Punishment of a One Time Offender

My time on the registry has been nothing short of a nightmare that you never wake. My crime was sexual assault of a child, sounds and reads horrible, however, they use to call it statutory rape or Romeo and Juliet case. I was 19 and she was 13, the sister of a friend that her mother was ok with the relationship. The father came home from desert storm and said no to the relationship and we respected that and broke it off. She explained how she felt and what our relationship was, and then I was asked to come down to the police department for questioning, not thinking that I was actually doing anything wrong cause it was consensual, I went down and was honest about everything. I was released with the information that they could have an arrest warrant for me and asked if I would turn myself in or would they have to come and get me, I agreed to the former. Sure enough two weeks later I received a call that stated that they had an arrest warrant for me, so I went down and had to wait 3 hours for the warrant to be issued, they told me that I would be arrested then released to wait for court. 90 days later I was still in jail waiting to be indicted, and sure enough, on that 90th day I was in fact indicted and went to court. I was given a court appointed lawyer (don’t ever do that if you can avoid it, it’s all a numbers game to them and they will trade you for another deal, they use sex offenders as tokens for deals with the AG) that told me that if I didn’t take the deal that they would give me 35 years in prison, and that she was in the courtroom ready to testify. All of which was a lie! I took the deal, 10 years’ probation and 180 day boot camp/work release program. What they didn’t tell me was what I would have to subject myself to while on probation. I had go to weekly meetings at a sex offender treatment program, call myself a rapist and tell my story over and over again sitting in a room with truly sick individuals, I would become physically sick at some of the stories I would be forced to listen to them every week, plus had to pay for the classes and probationary fees monthly all without a job, and if I didn’t pay I would be locked back up for non-payment. So I called my grandparents that was holding my inheritance from my father’s passing, they offered to pay for the probation and classes all up front, and they told him no. because if he did that and they had to revoke my probation for any reason that they would have to refund the money. So, I never paid them a dime, had no way to pay, couldn’t get employment. So I played this for almost 5 years on probation, got kicked out of therapy cause I wouldn’t call myself a rapist or pay the fees, in fact I said in group that they were in fact the rapist, for if you break down the word therapist is says “the rapist”. So, after 4 applications to revoke my probation (ATRP’s) for non-payment, I finally asked the judge to just sentence me to 5 Years of prison and leave me alone. As the law set at that time I would’ve been able to do my time and get out and move on with my life after paying my debt to society. I turned down parole twice stating that I didn’t want to be on paper of any sort, I wanted my life back. However, by the time I got out on November 23, 1998, the laws had been passed for the registry and they made it retroactive as far back a 1970. So, the nightmare continued even after 5 years in prison. I had to register with the city or county and the department of public safety for life, renewing my license every year, having my information available for all to see, my address, phone number, place of employment (not that there has been many other than self-employment), eye color, shoe size, email, any and all on line identifiers. With the registry it makes the 7 and 10 year background check for employment impossible to pass because it keeps it in the system like it just happened. In 2001 I met a fell in love with a wonderful woman of which had two sons that I came to love as if they were my own, their own father was a drug addicted idiot that was not in the picture, so they called me dad. We married in 2002 and everything was awesome, until the schools came out with the gator system that checked for people on the registry. At that time I was working for a retired Major and Mason that did security systems for the government and the local school system, everything was great until they installed that system and ran my id at one of the schools. That got me fired, even after this guy had sent me to get certified for the systems that he installed. I have gone to college for information technology and have two years toward a bachelor’s degree that I stopped because I will never be able to work in that field. I have been forced to create my own businesses and hide in the shadows placing my wife as owner of the companies, while I hide and do all the work from the shadows. Even built a satellite installation business and had 17 people installing for me with dish network, then one day they find out about my conviction cause of the registry and cancelled my contract and that affected 17 families and my own. Then I had to resort back to work that I did as a kid to earn extra money, I started mowing grass, built it up to a property preservation company and was doing awesome had people working for me doing property inspections, mowing empty properties. Had everything going again then bam, the registry cost me that contract as well, so I started working by myself mowing and lifting and has come to a point I am now disabled with a bad acl reconstructive surgery and 3 deteriorated disk in my lower lumbar with two other bulging disk in my back, almost to the point of being stuck at home in a wheelchair, because of the registry I cannot get hired at a less physical job that I was actually going to school for, I have to depend on my wife to work while I wait on Social Security Disability. I can’t even be considered for jobs that are for the disabled.
Over the years, being 19 at the time and 45 now, I have had to lie, manipulate, and cheat to get the basics needed to live. I was never able to volunteer for my own kids’ school for father/son projects, never been able to attend any of their school functions, they had been ridiculed for my past by their friends as to why their father never came to support them. They were never allowed to have friends spend the night for sleepovers, never able to hand out candy on Halloween or even take them trick or treating. It has been a very sad journey for something that was supposed to be a 5 year sentence. The registry is a life sentence with lifelong punishment for not only the offender, but his or her family and friends as well. Especially for single offenders, what ever happen to a second chance? Now I whole hearted believe that if an offender commits another crime they deserve all of these restrictions, and even some of the offenders that their crime was extremely heinous, but not for just dating a friends sister with the permission of the mother.

We'll here it goes. I had a girlfriend and she had a daughter. We meet at our work. We started dating and after awhile we moved in together. There was and incident involving her kid and it blow out of perportion. And it was OK then we had a kid and seven years later everything was going good. Then her daughter started dating this boy her mom didn't like. There was a big blowout about this. She broke up with him and started seeing another boy then she and boyfriend ran away stole a car 5000 grand a diamond ring. Wrote letters saying I molested her which I didn't so then it all goes down hill for me. I got an attorney for close to year or more in a out of court my attorney at the time was mad at me cause I didn't bring my workman's comp case to him. Which I didn't know at that time. So he advised me to take a plea at the time he didn't tell me what I was in for he said it was a felony charge but he didn't tell me all the other rules. So needless to say here I am lost my daughter and everything else and my sentence will never be over. I have never reoffended in eleven years but the rules keep changing and no one wants to help a sexoffender we are all scum no matter what you did or didn't do. Attempted aggravated sexual battery. Is what I took a plea for. The other reason is because my stepdaughter grandparents knew the District Attorney so I thought my chances where slim. If I knew what i was going to have go through I would have do things differently. I have never failed a polygraph. I was so stupid. I wish I could change all this I want people to see me as a human being. Thanks for reading this.

Shame, Isolation and Banishment

There is so much I've learned about these laws over the past five years that I'd like to unlearn but can't. One feels a bit like Kafka's Samsa; one day you are traveling salesman and the next day, a giant insect whose family in the end is relieved that you died. Perhaps Kafka's "The Trial" and Joesph K. is an even more fitting description of what this experience is like.
I was convicted of a non-touch offense and given many years of supervised release plus the registry. Of course, there isn't a day that goes by in my life that I don't regret what I did. I literally threw my life away and I had a professional career and life which is gone, forever. I'm not qualified for most welding/mechanical jobs that most sex offenders are forced to get so I remain unemployed. I did not end up going to prison and am extremely grateful for that. But even though polygraphs and many experts have shown and agreed I have never physically touched anyone and I am not a risk to do so, that fact will never be believed by the general public because of the public registry. Since my conviction I've read many people actually prefer prison to life on the outside being a registered citizen. Before being brandished from my community, that statement might not have made any sense to me but because I'm living it, I don't doubt it. Neighbors who shun you because you lower their property values, former friends and associates who pretend that you don't exist, having an "elephant in the room" that is always there no matter who you are talking to, fearing that any day a new buffering zone restriction will be passed in your state forcing you to move, watching people look at you as though you are Frankenstein's monster despite the fact that you know the truth about yourself.
Let me say this: We haven't reached the phase of genocide that Hitler's Final Solution provided for in the killing of 6 million innocent people, but we are moving in that direction. That may sound like an extreme statement but everyday as I watch more laws being passed, I am forced to come to that conclusion. Jews were not put in concentration camps on day number one of the Nazi regime. It escalated. Don't believe me? It's actually happening.I look at "Miracle Village" in Florida as being like a modern day Jewish Ghetto in Warsaw Poland. The implication is that these people need a colony of their own outside of the general community because God forbid they may contaminate or poison the community by their mere presence. Doesn't this sound pretty similar to another well known ideology? This really should not be a surprise; many politicians have made off-the-cuff remarks (and not so off the cuff) about how nice it would be if penal colonies for sex offenders existed. And it isn't just happening in Miracle Village. Clustering is happening all over the country, especially in more restrictive states. Certain cities, towns and municipalities can pass ordinances to keep sex offenders out. The Massachusetts Supreme Court recently compared these laws to Japanese Internment Camps. Do I personally worry about how this escalation can effect me in the future? I don't know how I could be human and not worry about it. It's a fact that's staring me in the face that I'd rather ignore but can't.
I could write a polemic here based on my experiences and research but alas I will cut it short. I just wanted to get in my two sense. I hope other people can resonate with how I feel.

23 years of mayhem

I am from Utah. 23 years ago I plead guilty to attempted aggravated sexual abuse of a child. The penalties of the law for pleading guilty were laid out. I would have to "Register" at the Courthouse once a year for 3 years. 3 years parole. Judge said in court I was looking at doing considerably less than 5 years. Everything that was thrown at me is what is referred to as a "Legal Fiction" I had no idea they could just change the law anytime they wanted without any due process of the law, and that I would become subject to those laws or I would have fought for reduced charges. I did 11 years in prison. The time on Parole changed to 5 years. I was violated 3 different times on "Technical Violations" None of the violations had anything to do with a sex offense. Then in 2008 when I was just ready to get off my 5 year parole I was informed it was now ten years parole. So after being out for 7 years they decide because of a traffic violation that went to warrant I needed to go back to prison. Adult probation and parole recommended 4 years for the violation!!!! Lucky the people whom I love, neighbors included showed up and fought to get me released. I did 6 months. I now have another 10 year parole to do. I was convicted in 1993. This nightmare is never going to end for me. I took a polygraph test so that my granddaughters could live with me. They asked me every sick question possible and I passed 100%. Now that the system has turned prisoner for profit, and they use sex offenders to extort money from the taxpayers by scaring them, I am doomed!!! Oh Utah just created a bunch of reform laws that would help me. But I don't fall under them because of the date of my conviction. But the laws that hurt me I fall under even though it was not a law when I entered my Plea? Funny huh, For some readers I am sure it is. This looks like a good website. I hope people will educate themselves to the truth about everything that is going on. Its a industry now for a lot of people. They depend on sex offenders committing crimes so they can make a living. It's very sad, one of the saddest things is now is they are throwing children in the checkout cart. It really does boil down to money. Taxpayer Money! How did I get here?

My son was/is addicted to online pornography all types, and is incarcerated. He is non-violent, but being treated like he was.
I have gone through disappointment, embarrassment, guilt, depression, anger, money and now mislead.
The system said he would serve his time and get off with good behavior, and extra credit for taking classes. They never told us it's impossible to find a place for him to reside. His PO told me He has to wear a monitor, no internet access where he resides, Land line only. Must pay for weekly counseling and pay an annual fee to the city he resides in. He must also pay for a yearly polygraph. Now to find a job to do all this. If not able to meet these, he stays in prison.
What ever happened to second chances?

A few years ago I got sucked into a virtual world that was plain wrong. My crime is possession of child pornography and though I don't exactly know why i did it, the only thing I could relate to it was an addiction. I know for a fact that it is wrong and I needed help though I was to afraid of trying to seek it. After a 4 year investigation my final court date is tomorrow in which I will accept a plea deal of 2 years time and 10 years probation. Words can not begin to describe the fear which is flowing through me, and the worst part is I am only 26 and I feel as though my life is over. I have struggled with depression and anxiety my entire life and this is doing nothing but exacerbating the condition. I ruined my chances at a great career and a great life and now I fear as though I may not make it out of prison alive mentally and or physically. A few years ago I got sucked into a virtual world that was plain wrong. My crime is possession of child pornography and though I don't exactly know why i did it, the only thing I could relate to it was an addiction. I know for a fact that it is wrong and I needed help though I was to afraid of trying to seek it. After a 4 year investigation my final court date is tomorrow in which I will accept a plea deal of 2 years time and 10 years probation. Words can not begin to describe the fear which is flowing through me, and the worst part is I am only 26 and I feel as though my life is over. I have struggled with depression and anxiety my entire life and this is doing nothing but exacerbating the condition. I have a friend of mine that has done 13 years in prison and is serving his parole at home. The registering, ankle bracelet, permission to go to the store, all that. He just got out earlier this year around Feb. or March. What I find hard to believe is how stringent the parole officers are and the mistakes they have made and try to flip it on him even though he has reported the jobs he had had and then had to quit because of them trying to make him out like he was the guilty party and not following protocol to stay compliant. The first job he had to give up was because his PO didn't want to use his temp agency as the mediator to get his work schedule so he had to quit that job. He finally got on with a local store as a cashier and even reported where he was working, his schedule and what his job was which was a cashier. After being there for a week or so, his PO made him quit that job due to his interaction with people and who may have had kids and children. That's somewhat understandable but his PO turned around and told him that the next time he tries to get a job like that, that they would revoke his parole even though his PO had been told where he was working and always gave all information as to where al the places where he has applied at. All he wants is a job so he can take care of himself and not have his parents pay his rent, utilities and whatnot. It would be one thing if he was trying to do something underhanded or sneaky but he hasn't done no such thing. How is he supposed to live if PO's are being stingy as to where they work or have to use a different communication tool to obtain his work schedule to verify?

A good holiday weekend

I read a lot of stories here, I thought it may help some to read a good story from the holiday weekend.
My 4th of July was one of the best I've had in the last few years. I'm a little bitter with what has went on with these sex offender laws in this country, and I have to realize that it's not the countries fault, it's the lawmakers fault. When the Supreme Court sided with the the states and approved by a 5-4 vote, Megan's Law, saying that it was not ex post facto, it gave lawmakers the right to play judge with people who they've never met. They were able to come up with any bizarre sex offender law as a result of the Supreme Court of the US not doing what was fair or just, and allowing for this insanity to continue. So I am not a fan of the court system or lawmakers of this 'great' country of ours. Now I get to look forward to all the story telling about the monsters out to get the little kids on Halloween. Fun huh?

Megan's law is a sickening display of American law. After finding myself "tricked" by the state of Florida into becoming a registered sex offender; now I find myself being raped by the justice system because of a label. First off I took a plea agreement in 1992, when i took my plea, no judge told me about SO registration, nor was it in my plea agreement. They needed faces on the website when it was launched in 1997, so they worded the law so that people still on probation were to register, even though it was not part of their plea agreement. They achieved this by wording it the following way: "convicted on or after Oct 1, 1997, or still currently serving sanctions". The "still serving sanctions" part is the part that did me in, and it is the ONLY law in FL that is worded that way...all other laws say "convicted on or after a certain date". That has been found to be unconstitutional in several states...the last being MD last yr in 2014, when MD was forced to remove people who were convicted before Megan's law became active. Fast forward 22 years, and a lot of suffering and humiliation, and I move to Illinois in 2011. The ISP said I was not required to register in IL., and even faxed me a letter saying I had completed registration requirements. In 2014 I had contact with a rogue cop who decided he wanted to turn my life upside down. I had an apartment, a job, and a girlfriend. When I failed to register timely, he arrested me and seized all my computer equipment while I was in jail. Even though the law states I do not have to register, the DA is sitting on this case for over a year now and doesn't appear to want to let it go. The ISP refused now to talk to me when I called and asked why they aren't backing me up on the letter...after all, THEY have the final say on who registers in their state..not a cop. They want my blood on their hands, even though they are in the wrong....just because of the SO label. U have fewer rights than a murderer, and it shows this country at its most vicious and corrupt. I can only pray.

I'm Charles Farabee, and I'm a sex offender in South Carolina. I moved to Clinton South Carolina in 1996 from Thomasville North Carolina. Now before I moved to South Carolina I never been in any serious trouble with the law period. With me being a new face of the Clinton South Carolina population I met new people, new friends & new relatives. In 1998 I dealt with 2 girls that looked very adult like. They were living in a children's home/private school at the time. They told me their ages which they stated legal ages. So I did take their word for it cause again they did look extremely adult like. I dealt with 1 of them for about 4 days and we had sex maybe twice out of the 4 days we seen each other, and the 5th night I ended up having sex with the other female, but soon after that the person who was running that place at the time ended up pressing charges and I ended up getting charged and arrested for 2 counts of CRIMINAL SEXUAL CONDUCT W/MINOR. Now the females did admit to everything on their behalf during the questioning, preliminary hearing & at court. So I ended up getting 10 years suspended to 5 years probation. I didn't do no prison time, but come to find out 1 female was 12 and the other female was between 14 or 15 years old which I stated that I didn't know that which I honestly didn't. At the time I had just became 21 in march. I just feel that a person like myself and a few others who may have been tricked and lied to shouldn't have to live life like this. I'm no threat in no manner, but I have to live on with life suffering from this to where it's extremely hard to get a job even in restaurants cause I'm labeled as a sex offender. It's hard to find a place of residence, hard in so many ways in life while the victims of the past get to live on happily ever after and progress in life and I don't think that's right I shouldn't be doing a life sentence out here in the free world. I ran into a trap I did not see and made a mistake by it. Sex offenders in cases like me shouldn't be treated to where we living as the living dead to where we don't deserve anything not even life itself. Now I can't speak on the violent, sick minded & habitual sex offenders. I can only speak of me and those who are like me cause we don't deserve this.... Thanks for reviewing this!!

WI - HELP! I dont know what to do anymore.

At age 20, in Wisconsin (St. Croix county) I received a misdemeanor 4th Degree sexual conviction for having relations with 16 YR old who lied about her age. We dated for about 2 months and I had no earthly idea!! I was told I will not have to register as an offender at all. I later moved back to my hometown in Texas. After a routine traffic stop, I was told if I had a warrant in Minnesota and they wanted to extradite me. At that time I was then charged with failure to comply with offender registration. I was told I was charged for not letting MN know I was moving to TX (didn't know I had to if I wasn't supposed to be a registered offender in Texas or at all!!! Wasn't on any probation or anything). Which was a felony. Couple years later I missed by 2 weeks updating my address and then charged AGAIN felony failure to register. Now I have 2 felonies stemming from the Wisconsin misdemeanor. Is there a way I can get the misdemeanor off my record to put a end to all this madness in Texas? I'm 32 yrs old now. Legal help is needed!! PLEASE! This shouldn't be fair at all!!!!

MO - My story Failure to register

In the State of Missouri those that predate January 1 1995 are not required to register under State law due to the States Constitutions 13th amendment. But they claim that there is a federal obligation to register with the State. So the State will charge and convict those that predate the law under state law due to federal obligation.
In 2010 I was charged with a State law of failure to register. By this time I had done my research and had only to put a few things together. I was ready. By 2012 my case was dismissed without a word. I can’t even find a clue as to why. But I do know why. I had forced my public defender to ask a couple of questions I wanted answers to.
My questions were simple. If I am not required to register under State law due to the State Constitution then why am I being charged under a State law? If I am required to register with the State under a Federal obligation thus a Federal law then why am I not charged with USC 2250 failure to register under Federal law?
I also gave my public defender research that I was working on. I will give you an idea as what this research consisted of so you can look things up.
According to the US Supreme Court when one case results in two upheld verdicts (both standing) that may conflict with one another the State is required to ensure that no one is charged within such a conflict. If the State fails to do so and the defendant is forced to correct the matter then the State must pay without argument.
This was the first bit of research that I gave out. So my questions were backed up by case law and were starting to cause trouble. So all I had to do was show that there was indeed conflict between the two verdicts to cause the court to try and figure out how to get around this whole issue. I knew there was only one way. That is if I didn’t bring it up formally in the court. At the time I had reason not to.
Back in the 1800s the Missouri Constitution had an amendment that required people to swear an oath that they had nothing to do with fighting against the Union Army. This amendment found its way into the US Supreme Court and the court was trying to figure out how to remove it from Missouri’s Constitution. When the court looked to Congress as a possible they found that the US Constitution had something to say on the subject. The result is that Congress can not pass a law nor be seen to have passed a law that violates a States Constitution.
That got me looking for more on the subject and I found plenty. I gave this to my public defender and the court was silent from there on. I had shown that there was indeed a conflict. So for almost a year it was just going in to get a new date to go back to court to get a new date.
I continued to give out other findings of my research each time I saw my public defender. I gave him little things that showed that I could indeed win a case against the State. There is no way I could post all my research on this matter here. But at least you got a basic idea where to start looking.

Child custody brings new charges

I have a sex assault conviction in 1994 for pinching a nine year old girl inappropriately. Yes, I was messed up and high and yes, I did plea guilty to it in order to plea bargain and avoid jail time. I was naive.
I was sentenced to 4 years probation and classes. I was not required to register. There was no registration requirement in Colorado until three months after my conviction. A Year later I was required to register retroactively. That is additional, retro-active punishment.
I completed my classes, but failed probation and was revoked for drug use/failed urinalysis. I did use drugs. I readily take responsibility for that. I was sentenced to Six years in prison.
It get's so much worse. Read on.
After completing prison and still a level one offender now 14 years offense free, and one who's name did NOT show up on the internet, I met and fell in love with a woman in Arkansas I should have avoided. We birthed a beautiful baby boy and our relationship fell apart.
This woman has a known reputation for filing false charges and mental health concerns, although highly intelligent and manipulative.
When she began to act more and more toxic and insane around our baby, I did what any father would do. I filed for custody in the Arkansas family Courts.
She had a son whom I had contact with. He was fourteen. The week I filed for custody, the son claimed I had touched him inappropriately a year prior, not remembering when exactly. There was no date, no proof, no witness and he waited a year until he reported in conclusion of me wanting custody of his half brother- my new baby.
As a previous convicted sex offender I was arrested, held on a $1 million dollar bond and charged with a new sex offense as well as failure to register.
The young man would not show up on the day of trial. I was told I would get twelve years in prison for failure to register (statute allowed it) unless I plead to a non-sex class A misdemeanor for simple assault. Time served. I then took a plea bargain on the failure to register and did my one year in jail. I was in jail a month when SORSA came to the jail and said I had a new sex offense (remember I plead to a misdemeanor, non-sex offense for assault) and I was elevated to a class III sex offender requiring community notification and living restrictions. This is Arkansas and in that State there are 4 levels, not III like most States. I was now a level III. Not the highest.

My life has been a living hell. I can't find a place to live. I live in a garage. I tried to open a business but I couldn't. I wear an ankle bracelet and I have more restrictions than you can count. It is now 21 years since my initial and only sex offense. I have lifetime, level III registration, my ex has blogged me and my business all over the internet. I am absolutely miserable and absolutely angry and bitter.
Those of you who are SO's know about sexual history polygraphs. I've taken six in the last 21 years and passed each and every one of them which limit my one offense in 1994 as the only thing I have EVER done that was inappropriate.
We have to rally together and repeal these registration laws and we also have to start filing civil charges against anyone who posts untrue, misleading or anonymous web blogs and posts about us. I need serious help in dealing with the injustices.

I have a sex assault conviction in 1994 for pinching a nine year old girl inappropriately. Yes, I was messed up and high and yes, I did plea guilty to it in order to plea bargain and avoid jail time. I was naive.
I was sentenced to 4 years probation and classes. I was not required to register. There was no registration requirement in Colorado until three months after my conviction. A Year later I was required to register retroactively. That is additional, retro-active punishment.
I completed my classes, but failed probation and was revoked for drug use/failed urinalysis. I did use drugs. I readily take responsibility for that. I was sentenced to Six years in prison.
It get's so much worse. Read on.
After completing prison and still a level one offender now 14 years offense free, and one who's name did NOT show up on the internet, I met and fell in love with a woman in Arkansas I should have avoided. We birthed a beautiful baby boy and our relationship fell apart.
This woman has a known reputation for filing false charges and mental health concerns, although highly intelligent and manipulative.
When she began to act more and more toxic and insane around our baby, I did what any father would do. I filed for custody in the Arkansas family Courts.
She had a son whom I had contact with. He was fourteen. The week I filed for custody, the son claimed I had touched him inappropriately a year prior, not remembering when exactly. There was no date, no proof, no witness and he waited a year until he reported in conclusion of me wanting custody of his half brother- my new baby.
As a previous convicted sex offender I was arrested, held on a $1 million dollar bond and charged with a new sex offense as well as failure to register.
The young man would not show up on the day of trial. I was told I would get twelve years in prison for failure to register (statute allowed it) unless I plead to a non-sex class A misdemeanor for simple assault. Time served. I then took a plea bargain on the failure to register and did my one year in jail. I was in jail a month when SORSA came to the jail and said I had a new sex offense (remember I plead to a misdemeanor, non-sex offense for assault) and I was elevated to a class III sex offender requiring community notification and living restrictions. This is Arkansas and in that State there are 4 levels, not III like most States. I was now a level III. Not the highest.

Sentence Extended

I was sentenced to 8 months for "Sexual Assault of a Child" 15 years ago. Since then I have had many people give me a chance. Even with being a Registered Sex Offender.
On here it says How the offenders and their families are persecuted. Will, they are not the only ones. All my friends have come to me saying how they are being harassed by people for being friends with me. Luckily enough they have hung in there for me.
I know I did a terrible thing. I have been paying for what I did for over a decade and sincerely believe I will be paying for it for the rest of my life.
I just wish my friends, family, and girlfriend didn't have to go through this too. The only thing they did was trust me. Why should they have to pay for that.

I pled guilty to a charge of sexual battery in 2001. The "alleged" crime was against a women I lived with and had consensual sexual relations with. I pled guilty because of a little practice called prosecutorial blackmail. They used other charges with threat of maximum time to coerce a guilty plea. Nevertheless, that is not my story; In 2010 approaching the 10 year termination from the sex offender registry I contacted the Tennessee Bureau of Investigation requesting release from the registry. The first letter of response indicated all that was required was for me to go personally to a field office and submit fingerprints. I was incarcerated for unrelated charges and could not immediately comply. The following year pending my release I again wrote a letter requesting termination. I was informed that I would not be eligible for termination until April 20, 2020 more than 19 years after conviction. I have proof of registration and the State has stipulated in court documents that I was registered without violation in 2007 (ONLY BECAUSE I HAD A COMPUTER PRINTOUT FROM THE T.B.I. WEBSITE WITH MY PICTURE ON IT)
I began litigating this case pro-se in 2011 in Federal Court, that case is on hold pending state process. I filed a petition in State court in December 2013. I am still waiting for a decision. The states most recent position is that I was release without serving the one year sentence of my conviction. How could I be registered if I had never served the sentence? I now have an attorney and will continue to fight this case all the way back to Federal Court if necessary. If anyone has advice, resources, or input. Please post to this website. I have considered going to the media (20/20 or even Dr. Phil) This case needs media exposure so people will know the kinds of things the states are doing.

SC - Everyone not treated the same

I was arrested in 2009 for touching a teenager while extremely intoxicated. No excuse but still it happened. It was never something that I intended to do or planned but still the same it happened. I plead to Lewd act and was given 6 years in prison and 5 years probation. I served 3 years in prison and took the 6 month course for sex offenders in prison. Upon release, I still had to take a year long course at $25 a week, Pay probation $20 a week and was put on a monitor which is another $40 a week. Total I had to pay $85 a week and just getting out of prison had no job. Thanks to family I was able to keep up the payments and after a year am still unable to get work due to the charge. I have finished the class and now only have to pay $60 a week. Of course if you do not pay they will violate you but no one will hire me. Now I have been told that the monitor that I am wearing will continue the rest of my life due to new South Carolina laws (or as long as I am on the registry). I don't mind the registry but the monitoring seems to me to go to far. The biggest thing is that several of the guys that were in my year long class had the same charge or worse charges, but they are not on monitoring .Most did not even get prison time. It all depends on how much money you have and what attorney you had and the sentence can be night and day! The law states that anyone with CSC1 or Lewd act must me on electronic monitoring but yet not all judges put them on it. I am fortunate in that I have family helping me, but not everyone does. And what happens when my probation is over? If I move out of state will I still have to have the monitor? I am 60 years old and this was the first time I have ever been accused of something like this. Sometimes I think that it would have been better if I had murdered someone, they don't have to register. It just sucks. But I am going to try and take it to court as my probation term nears its end. Any help would be greatly appreciated.
